Conservatorship vs. Guardianship

In Texas, these terms are often used interchangeably in conversation but have distinct legal meanings:

  • Conservatorship (Family Court): Determines custody, visitation, child support, and decision-making authority for minor children when parents are divorced, separated, or otherwise not together.
  • Guardianship (Probate Court): Applies to an adult who cannot manage personal or financial affairs due to incapacity or disability. These cases are overseen by probate courts and involve ongoing court supervision.
